Better Shots (“we”, “us”, or “our”) provides the Service subject to these Terms, which form a legally binding agreement between you and Better Shots.

If you do not agree with these Terms, you must not access or use the Service.

You must be at least 16 years old or the age of majority in your jurisdiction to use the Service. By using the Service you represent that you meet this requirement and have the authority to enter into these Terms.

When creating an account you must provide accurate information and maintain the confidentiality of your credentials. You are responsible for all activity that occurs under your account.

Better Shots offers AI-assisted feedback on photographs together with related resources, features, and content (collectively, the “Service”). We may enhance or update the Service from time to time.

We may suspend or discontinue any part of the Service at any time, with or without notice, and we will not be liable for any resulting unavailability or changes.

You retain ownership of photographs, comments, and other materials you submit through the Service (“User Content”), but you grant us a worldwide, non-exclusive, royalty-free license to host, process, and display User Content solely for operating and improving the Service.

You represent and warrant that you have all rights necessary to submit User Content and that it does not infringe, violate, or misappropriate any third-party rights or applicable laws.

You agree not to upload content that is unlawful, harmful, abusive, defamatory, obscene, or otherwise objectionable, or that promotes discrimination, violence, or illegal activity.

You must not interfere with or disrupt the Service, attempt to gain unauthorized access, or use the Service for automated scraping or data extraction. We may remove User Content or suspend accounts that violate these Terms.

Access to certain features of the Service may require a paid subscription. By purchasing a plan you authorize us or our payment processor to charge all applicable fees using your selected payment method.

Unless otherwise required by law, all fees are non-refundable. We may change prices or introduce new charges with reasonable notice, and any changes apply to subsequent billing cycles.

All software, design elements, trademarks, logos, and other content provided through the Service (excluding User Content) are owned by Better Shots or its licensors and are protected by intellectual property laws.

You may not copy, modify, distribute, sell, or lease any part of the Service or included content unless you receive our prior written permission.

We collect and use personal data in accordance with our Privacy Policy, which is incorporated into these Terms. Please review it to understand how we process your information.

You are responsible for maintaining backups of your User Content. We are not responsible for loss or corruption of files submitted to the Service.

The Service is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we disclaim all warranties, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not guarantee that the Service will be error-free, uninterrupted, secure, or that any advice or results obtained through the Service will meet your expectations.

To the maximum extent permitted by law, Better Shots and its affiliates, officers, employees, agents, suppliers, and licensors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits or revenues.

Our total liability for any claim arising out of or relating to the Service will not exceed the amount you paid to us for the Service during the twelve (12) months preceding the event giving rise to the claim.

You agree to indemnify, defend, and hold harmless Better Shots and its affiliates, officers, employees, and agents from any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising from your use of the Service or violation of these Terms.

We may suspend or terminate your access to the Service at any time if we reasonably believe that you have violated these Terms or pose a risk to other users. You may stop using the Service at any time.

Upon termination, the licenses you grant to us regarding User Content will continue only as necessary for legal, regulatory, or archival obligations.

These Terms are governed by the laws of Italy, without regard to its conflict of law principles.

Any dispute arising out of or relating to these Terms will be subject to the exclusive jurisdiction of the courts located in Milan, Italy, and you consent to that jurisdiction.

We may update these Terms from time to time. If we make material changes we will provide notice through the Service or by contacting you directly, when feasible.

Your continued use of the Service after the revised Terms become effective constitutes your acceptance of the updated Terms.
